The Agency hereby provides notice that it entered into an emergency contract per S.C. Code Ann. §11-35-1570 with Vendor for the following supplies, services, information technology, or construction:

Domestic hot water system is down for an inpatient care facility which is in direct conflict with DHEC regulations and also sanitary safety.  OMH solicited for 3 vendors to provide the portable heater needed, Sunbelt only has large industrial boilers and W.C Rouse cannot get one within the time frame needed, Twin Systems was able to meet the timeframe with a quote of $14,368. The main hot water holding tank has ruptured which is causing inpatient facilities not to have hot water for patients.  The repair will take considerable time to repair correctly for hot water to be restored back to inpatient facilities.  In the meantime, OMH/PPS would like to rent a portable boiler to meet DHEC regulations until the issue can be fixed for our inpatient care facility.   OMH/PPS contacted two other vendors: Sunbelt only has large industrial boilers and W. C. Rouse cannot have one here until next week. Twin System is the only one that can deliver the portable boiler in less than 12 hours which meets DHEC requirements in the cost of $14,368.00.  Twin Systems was able to meet the turnaround time in getting the portable heater to the location the following morning.  As noted above, the hot water heaters were needed for a longer period of time originally thought which increased the cost to $19,816.33 for the months of August, September and October.  If the repairs go into November there will be an additional cost of $15,750 for portal heater and propane cost.  The cost for the welder quote includes repair, AI cost and PT – of repair is estimated to be $5,600 per the quote that was received from Twin System.  Twin System will supply a temporary domestic hot water boiler and propane for inpatient care facility.

PROTESTS:
Any actual or prospective bidder, offeror, contractor, or subcontractor aggrieved in connection with the intended award or award of this emergency contract, shall notify the appropriate chief Procurement officer in writing of its intent to protest within five (5) business days of the date this notice is posted. Any actual or prospective bidder, offeror, contractor, or subcontractor who is aggrieved in connection with the intended award or award of this emergency contract and has timely notified the appropriate chief procurement officer of its intent to protest, may protest to the appropriate chief procurement officer in the manner set forth below within fifteen days of the date this notice is posted; except that a matter that could have been raised as a protest of the solicitation may not be raised as a protest of the award or intended award of a contract.
A protest must be in writing, filed with the appropriate chief procurement officer, and set forth the grounds of the protest and the relief requested with enough particularity to give notice of the issues to be decided. The protest must be received by the appropriate chief procurement officer within the time provided above. Days are calculated as provided in S.C. Code Ann. § 11-35-310(13).
