The Agency hereby provides notice that it entered into an emergency contract per S.C. Code Ann. §11-35-1570 with Vendor for the following supplies, services, information technology, or construction:

Emergency Procurement Justification: Mobile Modular Building

The District respectfully requests approval of an emergency procurement for the purchase and installation of a mobile modular building to support additional staffing needs resulting from continued student growth.

In April 2026, the Board of Trustees approved additional staffing positions, effective July 1, 2026, in response to increasing student enrollment and operational demands. The District is appreciative of the Board’s support in approving these positions, which are essential to maintaining high-quality services for students.

Due to current space limitations within existing facilities, there is insufficient office space to accommodate these new employees. In order to provide appropriate workspace and ensure staff are able to effectively perform their duties upon their start date, a mobile modular building is required.

Based on vendor timelines, the delivery and installation of a modular building requires approximately 6–8 weeks from the time of order. To ensure the building is in place and ready for occupancy by July 1, 2026, procurement must occur immediately.

The Board also approved an update to the District’s procurement exemptions, effective July 1, 2026, to include one-of-a-kind items such as portable classrooms and modular buildings. While this update will support future procurements, the current timeline necessitates immediate action prior to the effective date of the exemption.

Pursuant to the South Carolina Consolidated Procurement Code, emergency procurements are permitted when there exists an immediate threat to public health, welfare, or safety, or when there is an urgent and unexpected requirement where delay would be detrimental to the District’s operations. In accordance with this guidance, the District has determined that the need to provide adequate workspace for Board-approved staff—necessary to support student services and daily operations—constitutes an urgent operational requirement. Delaying procurement would result in insufficient facilities for staff to perform essential job functions, thereby negatively impacting the District’s ability to effectively serve students.

This situation constitutes an emergency procurement due to:

  • The need to support Board-approved staffing aligned with student growth 
  • Insufficient existing space to accommodate new personnel 
  • Vendor lead times requiring immediate action to meet occupancy needs 
  • The operational necessity of ensuring staff have appropriate workspace upon hire 

Timely action is essential to ensure continuity of operations and to support the successful onboarding of new staff members.

For these reasons, the District is proceeding with an emergency procurement in accordance with the South Carolina Consolidated Procurement Code to secure a mobile modular building and ensure readiness for the upcoming school year.

Competition:
Competition was sought to the extent practicable. Vendor selection was based on ability to meet required delivery and installation timelines and provide a compliant solution at a reasonable cost. The total is for 24- month lease, delivery set up, and charges upon return.

PROTESTS:
Any actual or prospective bidder, offeror, contractor, or subcontractor aggrieved in connection with the intended award or award of this emergency contract, shall notify the appropriate chief Procurement officer in writing of its intent to protest within five (5) business days of the date this notice is posted. Any actual or prospective bidder, offeror, contractor, or subcontractor who is aggrieved in connection with the intended award or award of this emergency contract and has timely notified the appropriate chief procurement officer of its intent to protest, may protest to the appropriate chief procurement officer in the manner set forth below within fifteen days of the date this notice is posted; except that a matter that could have been raised as a protest of the solicitation may not be raised as a protest of the award or intended award of a contract.
A protest must be in writing, filed with the appropriate chief procurement officer, and set forth the grounds of the protest and the relief requested with enough particularity to give notice of the issues to be decided. The protest must be received by the appropriate chief procurement officer within the time provided above. Days are calculated as provided in S.C. Code Ann. § 11-35-310(13).
