The Agency hereby provides notice that it intends to enter into a sole source contract per S.C. Code Ann. §11-35-1560 with Vendor for the following supplies, services, information technology, or construction:

Miovision Technologies US, LLC will provide Miovision Opticom Cloud perpetual licensing, related vehicle and intersection licenses, compatible hardware, installation, configuration, testing, project management, SCDOT-related engineering/contractor services, customer support, and related implementation services for emergency vehicle priority control within the Waccamaw Regional Council of Governments (WRCOG) region.

The proposed procurement will support participating jurisdictions and emergency response agencies within the WRCOG region through a Master Sale of Goods and Services Agreement. The contract is expected to include multiple terms, schedules, phases, purchase orders, or written notices to proceed.

Description of Supplies and Services

• Miovision Opticom vehicle perpetual licenses;
• Miovision Opticom intersection perpetual licenses;
• configuration and testing of vehicle data for Opticom;
• Miovision Core hardware and Core Priority Control IO cables;
• antenna brackets, supplies, communications hardware, and related traffic cabinet equipment;
• SCDOT-required engineering or contractor services;
• installation and configuration of Opticom traffic cabinet equipment;
• project management, testing, turn-on, final configuration, customer care, and support services.

PROTESTS:
Any actual or prospective bidder, offeror, contractor, or subcontractor aggrieved in connection with the intended award or award of this sole-source contract shall notify the appropriate Agency Procurement Manager in writing of its intent to protest within five (5) business days after the date this notice is posted.

Any actual or prospective bidder, offeror, contractor, or subcontractor that is aggrieved in connection with the intended award or award of this sole-source contract and has timely notified the appropriate Agency Procurement Manager of its intent to protest may file a protest with the appropriate Agency Procurement Manager within fifteen (15) days after the date this notice is posted. However, a matter that could have been raised as a protest of the solicitation may not be raised as a protest of the intended award or award of the contract.

A protest must be in writing, filed with the appropriate Agency Procurement Manager, and set forth the grounds for protest and the relief requested with sufficient particularity to give notice of the issues to be decided. The protest must be received by the appropriate Agency Procurement Manager within the applicable time period. Days will be calculated in accordance with S.C. Code Ann. § 11-35-310(13).

The cost of such appeal will be borne solely by the appealing organization or individual.  The Council will issue a written decision within (5) business days of receipt of the appeal. Frivolous appeals will not be addressed by the Council. The decision of Waccamaw Regional Council of Governments is final.  There will be no formal debriefing on the Council’s decisions concerning the appeal.
