On May 13, 2022, Governor Henry McMaster signed H.4408, which included an allocation of $400 million to the Office of Regulatory Staff - South Carolina Broadband Office for the purpose of deploying broadband infrastructure. The Act states “It is vital to the state’s interest that grant funds be awarded for the deployment of broadband infrastructure in rural communities in the most expeditious manner possible. Accordingly, contracting with broadband service providers and the procurement of professional grant management, vendor, consulting, or other services and pursuant to this act should be done pursuant to the provisions fo the S.C. Code Section 11-35-1570 of the 1976 Code.” In addition, the Act states “The State Fiscal Accountability Authority shall serve as the procuring officer for the procurement process and is responsible for administrative duties related to the process and the contract awarded.”
The Office of Regulatory Staff - SC Broadband Office solicited proposals from three vendors for these services. Based on the evaluation of the offers received, Vizbii was determined to be the most advantageous offer to the State.

The South Carolina Department of Health & Environmental Control (DHEC) is seeking a qualified vendor to provide four new (4) Teledyne API (TAPI) T640X PM Mass Monitors with Federal Equivalent Method EQPM-0516-238 (PM2.5) and 239 (PM10) and seven new (7) Teledyne API (TAPI) T640 PM Mass Monitors with Federal Equivalent Method designation EQPM-0516-236 designation. The instruments provided must be compatible with the existing T640X and T640 Teledyne instruments. These instruments must employ a measurement principle of broadband spectroscopy using 90° white-light scattering with polychromatic LED. All eleven (11) instruments must be provided by the same vendor. All 11 instruments would share the same software, consumables, spare parts, and supplies to be compatible with our standard operating procedures (SOPs) for all instruments and would include the same training for them.

SCC is purchasing from Southern Educational Systems (2) PT-181 portable training unit specifically designed for the Direct Digital Controls industry. Install and rent a 30-ton chilled water air handling unit in the mechanical room at DHEC's location at 301 Gervais Street, Columbia, SC. On December 24, 2022 the chilled water coil on the fourth floor air handler at DHEC’s 301 Gervais Street location froze and burst flooding the lower three floors of the building. The part needed to repair the unit is a custom item and is unavailable for an expected 6 months. Without this repair, the 4th floor has heat but no cooled air. The rental and installation of a temporary unit to serve until repair parts could be obtained was solicited competitively using a RFQ, but award under that RFQ could not be made because all offers received exceeded the $50,000 RFQ limit. A new solicitation would require several more weeks as warmer temperatures are approaching. The fourth-floor temperatures are routinely exceeding 80 degrees many afternoons and the building usually runs about 10 to 15 degrees above outside air, with even warmer temperatures predicted and expected in the days and weeks ahead. This Emergency Procurement is being awarded to the lowest priced responsive and responsible offer received in response to RFQ 5400024770.

Winthrop University intends to procure services from Marketing Systems Group (M-S-G) including online panel-hosting and quota management for online Winthrop Polls. The CPOPR provides details of the desired sample and M-S-G develops the panel, ensures delivery of the survey, and confirms the final dataset includes responses that will accurately reflect the state of South Carolina based on demographic information. As the CPOPR moves to online-based surveys, M-S-G provides the specific type of sample needed to produce comparable results to previous Winthrop Polls. The South Carolina Department of Health & Environmental Control (DHEC) intends to award a Sole Source contract valued at $5,552,413 for three (3) years to provide ongoing implementation and software maintenance and support, including software patches and fixes, for ePermitting. ePermitting is DHEC’s online platform for environmental permitting, licensing, registration, projects, reporting, monitoring, complaints, compliance, and enforcement. ePermitting is designed to support the full regulatory lifecycle while allowing our customers to do business with the agency through the platform. ePermitting was originally purchased competitively for DHEC use in 2015 (solicitation 5400008580). This system as installed at DHEC includes the following modules: nVIRO, nFORM, nSPECT, nVISAGE, and nSITE Explorer. These products are all developed, sold, and have been supported by Windsor Solutions, Inc. which owns the source code to this proprietary software. In accordance with §11-35-1560 (A) of the SC Consolidated Procurement Code, it is the intent of the Medical University of South Carolina (MUSC) to award without competition, a sole source contract in accordance with Regulation 19-445.2105 (B) (5) to Inscopix, Inc. to acquire the Inscopix nVue System for Dual Color In Vivo Imaging with data acquisition and analysis software.
Basis of Sole Source:
The Medical University of South Carolina Department of Psychiatry and Behavioral Sciences BRAIN Division recently received a NIA grant titled "Sleep, pericyte and Alzheimer's disease" that requires a two-color imaging system to collect pericyte dynamics and neuronal activities at the single-cell level. The equipment required must: 1) have one channel (color) to visualize the pericytes and to measure the capillary diameter; 2) have a second channel (color) to record local neuronal activities reflected by Ca2+ sensor (GcaMP6). 3) have a single-cell resolution. The current Inscopix nVoke system MUSC has can only visualize one-color signals and does not have the capacity to measure vasculature diameter. MUSC will trade in the existing Inscopix nVoke system for an upgrade to the Inscopix nVue miniature microscope and data acquisition and analysis software. Inscopix is the sole developer and manufacturer of the Inscopix nVue system and software.
As there are no other vendors authorized to sell this system, this has been deemed by the Procurement Officer to be the only contractor that can fulfill the listed requirements which meets MUSC’s specific needs.

The Medical University of South Carolina’s (MUSC) Department of Engineering and Facilities (E&F) has requested emergency fuel delivery services from Colonial Fuel and Lubricant Service, Inc. Our current provider has canceled our recent order as MUSC prepares for the possibility of “Curtailment” from Dominion Energy. Curtailment is the temporary interruption of our natural gas supply per our agreement with Dominion Energy forcing us to use diesel to fuel our boiler plant during inclement weather. Once notified of curtailment, fuel needs to start arriving 24 hours after the curtailment notification which s presents the need to enter into an Emergency Procurement with a local fuel vendor—Colonial Fuel and Lubricant Services, Inc. MUSC must be functional at all times which means the fuel delivery is critical for our operations. Access to fuel is vital for operation on our campus, and any interruption in fuel delivery could be catastrophic.

The agency is currently using Kofax Support Services under a competitive solicitation contract 4400025702 of which Keymark, Inc. was the only response. Emergency due to license renewal of product/tool license. College of Charleston has used this system more than 10 years. For the past 3 months, the College has been non-compliant with our current Splunk license due to network growth and rapid system expansions. However, Splunk granted the College a complementary 3 month extension which allowed to allow us to sort/resolve issues and concerns related to managed services that provide our Security Operations Center. If the College does not issue a purchase order by January 31st, the College will incur additional charges associated with the complementary 3 month extension. Clemson University's Baruch Institute of Coastal Ecology & Forest Science is conducting research on microplastics in a variety of environmental samples. Processed environmental samples contain numerous particles of unknown composition, size, and color. We need the ability to scan areas with many particles, as opposed to one particle at a time, without damage to the particles. The instrument must have a wavelength tunable external cavity Quantum Cascade Laser (QCL) utilizing an angle tuned immersion grating as a wavelength selection filter covering spectra from 1,800 cm-1 to 975 cm-1 to determine particle composition along with automated focus, background in reflectance, and visible image collection capabilities to quantify particle attributes, such as the number of particles in the viewing area, their dimensions, and their colors. It is also necessary to be able to capture images within the original scanned image to examine particles in more detail without manual adjustments to the optics. The instrument must come with a library of known particle compositions that can easily be updated as new spectra are acquired for automatic referencing during the scans. The automated system will decrease sample process time (no need to manually count particles using a microscope prior to analysis) and sample cost. Agilent is the only vendor that allows for the QCL technology along with these scanning optics, automatic referencing of spectra, and simultaneous evaluation during measurement to determine particle attributes. This equipment cannot be purchased from any other distributor or reseller. For these reasons, this is a sole source procurement.
