Item is needed due to compatibility with equipment, accessories, or replacement parts. Clemson requires a corporate learning solution that is able to continue to manage employee training that Clemson has managed for the past 18+ years with no disruption of service or loss of historical training data. The solution is required to manage the training of University employees throughout their career. Clemson currently utilizes Skillsoft and as the solution used for years, is the only one that can deliver dozens of integrations with current competencies for Communication, Customer Services, Cybersecurity, Staff Leadership Develop Training, and Assessment & Accreditation. The Agency hereby provides notice that it intends to enter into a sole source contract per S.C. Code Ann. §11-35-1560 with Vendor for the following supplies, services, information technology, or construction:

The Medical University of South Carolina (MUSC), Engineering and Facilities, pursuant to §11-35-1560(A) of the South Carolina Consolidated Procurement Code, intends to award, without competition awarding a maintenance contract to C&C Boiler Sales and Services for the provision of parts, equipment, and labor associated with the maintenance and repair of the University's Cleaver-Brooks boiler systems. C&C Boiler Sales and Services is the sole manufacturer-authorized service provider for Cleaver-Brooks boilers in the Charleston area. As the exclusive authorized representative, the company is uniquely qualified to perform warranty-compliant repairs, maintenance, and diagnostics in accordance with the manufacturer's specifications.  Additionally, C&C Boiler Sales and Services is the only authorized company certified to program and service the Hawk ICS control system, a proprietary Cleaver-Brooks platform installed on all Cleaver-Brooks boilers across the MUSC campus. Because the Hawk ICS system utilizes proprietary software and programming protocols, no other vendor is authorized or equipped to perform these services.  As the manufacturer-authorized representative, C&C Boiler Sales and Services has direct access to genuine OEM replacement parts, specialized equipment, factory technical support, and the latest manufacturer updates. Utilizing any other vendor could compromise system reliability, invalidate manufacturer warranties, delay repairs, and increase the risk of operational disruptions to critical campus infrastructure.

Any responsible sources who wish to identify their interest and capability to provide these services must notify the Procurement Officer at singlewa@musc.edu no later than July 17, 2026 (12:00 a.m. EST). Telephone responses will not be accepted. Upon receipt of the interested parties' notification, the Procurement Officer will determine whether to conduct a competitive procurement or proceed with sole-source negotiations. PROTESTS (MAY 2019) If you are aggrieved in connection with the solicitation or award of the contract, you may be entitled to protest, but only as provided in Section 11-35-4210. To protest a solicitation, you must submit a protest within fifteen days of the date the applicable solicitation document is issued. To protest an award, you must (i) submit notice of your intent to protest within five business days of the date the award notice is posted, and (ii) submit your actual protest within fifteen days of the date the award notice is posted. Days are calculated as provided in Section 11-35-310(13). Both protests and notices of intent to protest must be in writing and must be received by the appropriate Chief Procurement Officer within the time provided. See clause entitled “Protest-CPO”. Contract 4400038998 was awarded 3/2/2026 to Mark43 as a replacement for SmartCop; however, it is anticipated that RMS will go live in November 2026 and CAD will go live in March 2027. Planning to decommission SmartCOP is in the works but won't be complete until after March 2027. Given the critical role the current system plays and the extended timeframe and risk associated with any transition, SCDPS intends to sole source maintenance on these systems to ensure continuity of operations, officer safety, and public service with uninterrupted access to this system.

In addition, these products and services are proprietary to SmartCop. SmartCop is the original and sole developer and technical support provider for its software, maintenance, and updates. Officer safety issues could result without the use of these SmartCop solutions. Without software updates and maintenance, applications may become non-compliant with various legal/regulatory requirements and standards. SCDPS intends to sole source these products and services in accordance with Regulation 19-445.2105 (B}(1); where the compatibility of equipment, accessories or replacement parts is the paramount consideration and (8)(5) where the item is one of a kind.

Patriots Point Development Authority is a state agency comprised of two National Historic Landmark Ships that serve as museums, a Vietnam Experience, a Cold War Memorial, and a Medal of Honor Museum. Over 300,000 visitors visit the museum annually and the museum is open nearly every day of the year. For security and safety reasons, the agency has deemed it necessary to have active Mount Pleasant police officers on site patrolling the grounds most days. The ability to have these officers on site is strictly handled by the vendor.

Patriots Point Development Authority requires a Point of Sale program in order to sell admission tickets to the agency's Naval & Maritime Museum. The agency does not receive state appropriations for operations and admissions to the museum constitute 60% of PPDA's annual revenue. Various POS systems exist, but because of the State's mandatory electronic payment processing restrictions, the agency has not been able to identify alternatives to Gateway's Galaxy platform. PPDA will contract for Gateway for FY26-27 while alternatives are sought for future fiscal years.

The Agency hereby provides notice that it intends to enter into a sole source contract per S.C. Code Ann. §11-35-1560 with Vendor for the following supplies, services, information technology, or construction:

Horry County Schools Learning Services intends to procure LETRS Facilitator Training from Lexia Learning Systems LLC to expand local certified facilitator capacity for district-led LETRS / K–3 Read to Succeed implementation pursuant to Act 114. SCDE guidance identifies LETRS as the state-selected professional learning program for required foundational literacy training, and participation in LETRS is required for K–3 certified educators and elementary administrators. SCDE guidance also identifies completion of LETRS Volumes 1 and 2, with required mastery levels, as an approved pathway toward the R2S Literacy Teacher endorsement. HCS currently has existing Local Certified Facilitators; however, additional facilitator capacity is needed to implement LETRS efficiently, consistently, and sustainably across the district, increase cohort availability, support Title I schools, and reduce reliance on a limited number of facilitators. LETRS Facilitator Training, certification, materials, digital platform access, and facilitator resources are proprietary to Lexia Learning Systems LLC. Only Lexia is authorized to train, assess, and certify LETRS facilitators and provide the official materials, platform access, assessments, and delivery protocols required for individuals to become certified LETRS facilitators. Other vendors may provide literacy, reading, or science-of-reading professional development; however, they cannot certify additional HCS staff as LETRS facilitators, authorize staff to deliver LETRS professional learning, or provide access to Lexia’s proprietary facilitator materials and platform resources. Substitution with another provider would not meet the District’s specific need because it would not produce additional certified LETRS facilitators or support the official LETRS implementation model selected and supported by SCDE. Accordingly, no other vendor is capable of providing the required LETRS Facilitator Training, certification pathway, platform access, and associated materials necessary to expand HCS’s local LETRS facilitator capacity.

The anticipated value of this purchase is approximately $299,970.00, based on Quote #Q-728309-6 for 15 LETRS Facilitator Bundle licenses for Volume 1 and 15 LETRS Facilitator Bundle licenses for Volume 2, not to exceed $300,000.00 for the period July 1, 2026, through June 30, 2027
